VA-ROL Members -

The state and local general schedules for law enforcement records were updated this morning by the Library of Virginia's Records Oversight Committee. The same three series were added to both schedules.

As a result of the overhaul to the Virginia State Police schedules, and on the advice of VSP staff, two series were removed from those schedules added to the general schedules so that all LE agencies may benefit from having series available for "FCC License Records" and "Special Assignment Records."

Another series added to both schedules is "Arrestee Personal Property Inventory." This series covers a law enforcement agency's inventory of personal effects removed from an arrestee before transferring the arrestee to a regional lockup.

Those updated schedules may be accessed at GS-17<http://www.lva.virginia.gov/agencies/records/sched_local/GS-17.pdf> for localities and regional entities, and at GS-117<http://www.lva.virginia.gov/agencies/records/sched_state/GS-117.pdf> for state agencies.

On another note regarding law enforcement records, many questions abound on the retention of records created by body worn cameras (BWC). There are high-level groups working on this issue from both the policy and the records-retention perspective. Hopefully there will be fruit from this work towards the end of the calendar year. Until further guidance can inform any needed change to the retention schedules, the series recommended to cover these records determined not to have evidentiary value are:

Localities: GS-17: 100796: Recording, Surveillance, or Monitoring Systems: Not Used as Evidence
State Agencies: GS-117; 012311: Recording, Surveillance, or Monitoring Systems: Not Used as Evidence

BWC records determined to have evidentiary value should be classified with the appropriate Investigative Case File series.
