I just received an email from John Whitmore. Here is his reply:



Per the Code of Virginia  § 2.2-3704 (A). Except as otherwise specifically provided by law, all public records shall be open to inspection and copying by any citizens of the Commonwealth during the regular office hours of the custodian of such records. Access to such records shall not be denied to citizens of the Commonwealth, representatives of newspapers and magazines with circulation in the Commonwealth, and representatives of radio and television stations broadcasting in or into the Commonwealth. The custodian may require the requester to provide his name and legal address. The custodian of such records shall take all necessary precautions for their preservation and safekeeping. (Bolded for emphasis).



The Virginia Times is a bona fide Virginia news media corporation in good standing, with news channels and publications available to all citizens of the Commonwealth of Virginia. I kindly ask that you reconsider this false determination.

The Virginia Department of Minority Business Enterprise is in receipt of your request for information under the Virginia Freedom of Information Act, § 2.2.3700 et seq., Code of Virginia. Please be advised that under §2.2-3704(A) of the Code, such requests can only be prepared and submitted by citizens of the Commonwealth, except as otherwise specifically provided by law.

Several agencies have received Freedom of Information Act (FOIA) requests for Certificates of Records Destruction (RM-3 Forms). Per GS-101 100365 Records Management Files - Approved Certificates of Records Disposal (Form RM-3), you should have three years worth of RM-3 Forms in your office. After you have provided those forms to the requester, please direct this individual to contact the Library directly to place a FOIA request with our Public Information Office, Jan Hathcock, for any older forms.
