I'm not a copyright expert. But Sharon Carmack has just published a  
new book that covers copyright, fair use, and public domain issues.  
The title is Carmack's Guide to Copyright & Contracts, A Primer for  
Genealogists, Writers & Researchers, published by Genealogical  
Publishing, Inc. It is very helpful. Copyright laws are complicated.  
Consequently, I would get some sound advice before proceeding. The  
issue is not just whether the book is out of print, but also whether  
the copyright has been extended. Good luck.
