That is an excellent question, Ms. Litton. 

 

Bowing to anything staff of LVA’s records retention unit says, my observation is that certainly any personal information about (i) students or (ii) patients under social, legal, or medical care -- those served by agencies across Virginia, should be kept confidential, due to various federal and state laws.  Access of staff should be a key issue in a risk analysis performed at an facility that has a core of sensitive records located at most any school or health services or social services facility in Virginia.

 

I offer this not as legal advice; all local and state agencies should consult their legal counsel, whether its in the OAG or not, if they have a legal question about advice proffered by a guest on this listserv.

The Library of VA (VA Public Records Mgmt. Manual) states records should be stored, whenever practical, in a secure area with controlled and documented access for personnel. Doesn't say anything about what should be posted on the door. Our records rooms are kept locked at all times and only certain employees have access.

Is there a Virginia Code or other legal statute that addressing specific postings that should be on a records room door?  Should the posting identify the names of the people that should have access to the records room?  Or can it just say....Authorized personnel only.
