It's well tested in the case of vandalism. In the case of
archaeology, it has stood one test that I'm aware of. It
really takes a hard-nosed don't take no for an answer
attitude to get things moving in some cases. In others, it's
a slam-dunk. Depends on localities.

there's always wiggle room. One can claim that one didn't
know what one was doing, that it wasn't known to be illegal,
etc. but that one's not holding much weight of late.
