Around the same time as the Charles City marriage mentioned by Lou Poole,
George  Washington's great-grandfather John Washington wedded a
twice-married widow, Anne Brett; and when Anne died, John married her
sister, the already thrice-married Frances Appleton.  This was in
Westmoreland County, and I found no mention of a legal challenge.
