The simple answer is "yes, one could", UNLESS that servant was prohibited by reason of his/her criminal record there (or here) or any other court imposed legal debility.  

However, the fact of servitude itself did not reduce nor add to whatever rights those who arrived here as servants had been accorded as Englishmen in Britain; they were citizens of England there and here, as well.  However, despite that naked fact, virtually all servants were under restrictions that were not of the making of Parliament, the Crown or the courts.  

Those restrictions, first set forth by the Virginia Company and then for a century and more after 1650 by the terms of their contracts of servitude, were strict and widely encompassing as to the freedoms of any servant, English or otherwise.

And many were such terms; too numerous and varied to repeat here, however, no better illustrations of such agreed codes of conduct likely exist than those to be found in "York County Records, vol. 1687-1691", p. 36; Neill, "Virginia Carolorum" p.57, and "Henrico County Records, vol. 1677-1692", p. 424.
