Thanks a million to all who replied to my question. This brings up another question from my genealogical standpoint. The situation is this: Priscilla Bennett is my 7th great grandmother. She and John Dugger married sometime before 1751 (but not too many years). They married in Brunswick County but the Dugger's and Bennett's had lived in Surry County before moving to Brunswick County in the early to mid 1740's. They had several children but the exact ages of the children are unknown.

My question is this: Would Etheldred likely have been an older child, say at least 10 or 12, when he was bound out in 1746? If Priscilla and John Dugger got married about that time (could have been), could Etheldred have been bound out to John Dugger? There are fairly good records available in Brunswick County on John until his death in 1803 but Etheldred is never mentioned, even in his will. I have found no other record on Etheldred Bennett or Dugger.

Another question and I think I have heard this discussed before but can't remember the answer. Was there a legal minimum age to conduct legal business in Colonial Virginia? Things such as signing as witness, buying property, etc.

Thanks for any information. I really appreciate it.

Johnson (1755 and 1802) defines the term "warden" as "a keeper", a "head
officer", and "a guardian". Albemarle Parish here was ordered by the court
to take charge of the child and "bind it out".

This "warden" (who regularly performed such tasks through his position in
the church hierarchy his office of the church) saw to it that the child was
placed in the home of a parishioner who would agree to such actions. The
child was bound for varying lengths of time and the conditions under which
he/she remained and worked for that that new guardian - "master" - again
varied depending upon all the circumstances if the matter.

Subject: [VA-ROOTS] Court Order Meaning

I found the following in Surry County records:

"Oct. 1746 - Ordered that Church Warden of Albemarle Parish bind out
ETHELDRED baseborn son of Priscilla Bennett according to law."

I know that this means that Priscilla Bennett had an illegitimate child but
what, exactly, was happening with this court order?

Thanks for any information.
