Hi List Mates

I could sure use some assistance in understanding the circumstances pertaining to the below document.

1)  May we assume the person owning the property was no longer in this area?

2)  If he had remained in the area, what punishment/penalty would he have met?

3) Can anyone point me to the law of the General Assembly this is referring to?  

4) Does anyone know precisely when this started and ended?


I am removing the name of  the land owner (loyalist) and the county from this document.  I don't think this should make any difference, but if it should let me know and I will be glad to share privately.

This Indented Deed of Inquest Taken before Thomas Napier Escheater for the County of XXXXXXXXX bey John Handcock, Henry Haislip, Duncan McLuchlan, Robert Allen, Richard Napier, William Barnet, James Cole, Pat: Napier, Thos Linthicum, Robert Knight,  Fisher Rice Bennett, John Williamson, Jurors, good and lawful men of the said County, having met on the premises and impannalled, were tryed and sworn the truth to speak wheather the Estate real and personal once of the property of [name removed] of the Kingdom of Great Britain Escheats to the Common Wealth the jurors having hear and considered the matter do say, That [name removed] is a Subject of Britain and is sound Seized in fee simple of two hundred acres of Land within this county Joining the lines of Benjj. Bellamey, Jon Moore, and John Pace, which Escheats to the Commonwealth agreeable to act of Assembly concerning escheats and forfeitures frm British Subjects.  In Witness whereof the Escheater and
 Jurors have hereunto Set their hands and Seals this 3rd day of September 1779.  And in the fourth year of the Commonwealth.
