It is MUCH more likely that he was of age, however your question was whether of not a man HAD to be 21 to operate a "ordinary"; to that, the answer is no.

  This license was issued in Jan 1755. We show this Henry born c1735. The
  ability to pin down more accurate dates of birth is always welcome, even if
