Mr. Link:  This is in response to your e-mail message to Rosie Egan as
listed below.  The answers to your questions are as follows:

 

1.	Has the freeze been lifted?  No.  The instructions listed in
Section 30ff of Chapter 7, Publication 100-01 are still in effect.
Please see the last paragraph of Section 30.10 which states the records
that have been identified by CMS as those under the freeze. 

 

2.	Who does the term "contractors" apply to?  Contractors are the
entities that the Centers for Medicare and Medicaid Services (CMS)
contract with to process and pay claims for Medicare beneficiaries.  In
addition, these contractors provide education and training services to
Medicare providers.  CMS is in the process of finalizing the
implementation of Medicare contracting reform and this should be
completed by the end of the calendar year.  You can visit
www.cms.hhs.gov/medicarecontractingreform for more information on the
entities with which CMS contracts.

Dear Deputy Administrator Egan, 

CMS Manual 100-01 General Information, Eligibility, and Entitlement
Chapter 7, Section 30.30 states that there exists a freeze on
contractors destroying Medicare billing and related records.

1.  Has the freeze been lifted? 

2.  Who does the term "contractors" apply to? (I looked for the
definition elsewhere in the manual, but couldn't find it.)
