Thanks so much, I was able to find the statute via Google Books

What is still missing is the rate of taxation which I'm still working on.

The October 1748 statute titled "An Act for preventing losses from drivers passing with horses and cattle through this colony; and for laying a duty on horses imported, and for the more effectual prevention of horse stealing" in Hening Vol. 5, p. 124ff may be the answer to your question.
