Frank S. Walker, Jr., farmer, lawyer and chronicler of Orange County, begins
Chapter V of his "Remembering:  A History of Orange County, Virginia" with
the following comments, which seem applicable to the revival of
Nullification on this list:

	"As a local historian, this writer has probably heard all of the
descriptive names for the ware which convulsed America from 1861 to 1865.
Some qualify as cocktail party humor, others as serious political
statements.  It is clear that the Confederate government wanted to exist
separate and apart from the Federal government, not overthrow and replace
it.  From that standpoint, the struggle easily earns the title of 'War for
Southern Independence.'  Beyond that, the naming issue gets fuzzy.
	"The Federal government, for all its pronouncements about dealing
with a domestic internal rebellion against it by a dissident minority - a
'civil war' - blockaded Southern ports to all shipping, agreed to a prisoner
parole and exchange protocol with the Confederate government, and engaged in
a systematic and widespread destruction of the infrastructure and the
economy of the South.  Those acts in combination were routinely seen in
nineteenth century contests between belligerent nations, but almost never in
civil wars.
	"That said, America's 1861-65 war is being called a 'Civil War' in
this work.  Three reasons:  First and foremost, the North won, so they get
to name it.  Second, it is a short, universally-recognized title for the
conflict.  Lastly, the story of the impact of that war on Orange County and
its residents is more important that any debate over what to call it."

While the result may not have been to everyone's liking, has not the
question of Nullification been decided?

It is about time states take back their powers and rights as guaranteed by
the 10th Amendment; I should also say the people should also demand their
rights back.  Over the past 140 years the rights of the people and states
has been usurped by the Federal Government,

Following in the steps of Jefferson and Madison in the
Kentucky and Virginia resolutions in 1798 in opposition to the Alien and
Sedition Act, the State of Texas has a resolution pending and supported by
Governor Rick Perry affirming the sovereignty of the state, and affirming
the
state's right to nullify Federal legislation beyond the scope of the powers
granted to the government in the Constitution. The resolution clauses read:

RESOLVED, That the 81st Legislature of the State of Texas hereby claim
sovereignty under the Tenth Amendment to the Constitution of the United
States over all powers not otherwise
enumerated and granted to the federal government by the Constitution of
the United States; and, be it further; ?

?RESOLVED, That this serve as notice and demand to the
federal government, as our agent, to cease and desist, effective
immediately, mandates that are beyond the scope of these constitutionally
delegated powers; and, be it further; ?
??????



?RESOLVED, That all compulsory federal legislation that directs states to
comply under threat of civil or criminal penalties or sanctions or that
requires states to pass legislation or
lose federal funding be prohibited or repealed; and, be it further;
